Terms of Service

1. Agreement

By using https://stampedsidewalks.com("Site") you agree to these Terms. If you don't agree, don't use the Site.

2. The service

We provide an online tool to design custom HDPE concrete stamps and order them produced and shipped to you. Pricing is shown in real time as you design. Order minimum is $100 USD per stamp.

3. Custom-made goods are non-returnable

Each stamp is manufactured to your specification. Once production begins, your order cannot be cancelled or returned. We will replace any stamp with manufacturing defects (see Refund Policy).

4. Your content & intellectual property

• You retain ownership of designs, text, and images you upload ("Your Content").
• You grant Rullands Creek Enterprises LLC a worldwide, royalty-free license to host, manufacture, and ship Your Content for the purpose of fulfilling your order, and — if you submit to our public Gallery — to display and promote it.
• You represent that you own or have permission to use Your Content, including any names, likenesses, copyrighted text, or trademarks.
• We may refuse any design that infringes intellectual-property rights, violates the law, or is hateful, harassing, sexually explicit, or otherwise objectionable in our reasonable judgment.

5. DMCA takedowns

Send takedown notices to dmca@poetryinstone.local with the elements required by 17 U.S.C. § 512(c)(3).

6. Accounts

You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

7. Payment & B2B terms

• B2C orders are charged immediately at checkout via Stripe.
• Approved B2B accounts (contractors, municipalities) may pay on Net-15 / Net-30 / Net-45 / Net-60 terms via Stripe Invoice. Late payments accrue 1.5%/month or the maximum allowed by law, whichever is lower.
• Sales tax is collected automatically based on your shipping address. Tax-exempt entities must provide a valid exemption certificate before their first order — email it to support@stampedsidewalks.comand we'll mark the account exempt.

8. Shipping & risk of loss

We ship to addresses in the United States and Canada. Risk of loss passes to you on delivery to the carrier. See the Shipping Policy for details.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Limitation of liability

To the maximum extent permitted by law, Rullands Creek Enterprises LLC's aggregate liability for any claim related to the service or your order will not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages.

11. Indemnification

You agree to indemnify Rullands Creek Enterprises LLC against any claim arising from Your Content or your breach of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Minnesota, USA, without regard to its conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Hennepin County, Minnesota.

13. Changes

We may update these Terms. Material changes will be communicated to account holders by email at least 30 days before they take effect.
